<p>NAIROBI, Kenya — The spark for Kenya&#8217;s firestorm of ethnic violence was lit inside a cavernous meeting hall in downtown Nairobi , where election officials over four days doctored vote counts, dismissed eye-popping irregularities and thwarted monitoring by independent observers to deliver a razor-thin victory to President Mwai Kibaki .</p>
<p>Observers who were allowed into the vote-tallying center on Dec. 29-30 , hours before the results were announced, said there was so much systematic fraud by Kenya&#8217;s government-appointed election commission that it&#8217;s impossible to know who really won.</p>
<p>The extent of the commission&#8217;s deceptions has faded into the background as more than 800 Kenyans have been killed in ethnic clashes and police crackdowns. The events also have deeply unsettled the Bush administration, which has relied on Kenya as an ally in the war on terror and a bulwark of stability in East Africa .</p>
<p>Official results gave Kibaki an edge of 231,728 votes, or 2 percent, out of about 10 million cast. Initial results of an exit poll by the U.S.-funded International Republican Institute found that rival Raila Odinga had won by an 8 percent margin.</p>
<p>Election officials allowed five accredited Kenyan observers into the tallying center in Nairobi only in the final phase of vote-counting, and three of them shared their accounts with McClatchy. <strong>All said that the gravest cheating occurred in that room, where commissioners— <em>all appointed by Kibaki</em>— compiled returns before announcing them to the public.</strong></p>
<p>The observers spoke in interviews and quoted from a joint log of their experiences, titled &#8220;Countdown to Deception,&#8221; which Kenyan rights groups are circulating.</p>
<p>The long-serving chairman of Kenya&#8217;s election commission played an active role in the deception, the observers said. When a tallying officer presented results showing voter turnout at 115 percent in Maragua, a Kibaki stronghold in the central highlands, commission Chairman Samuel Kivuitu didn&#8217;t invalidate the result as required by law, but allowed a commissioner to reduce the figure to 85 percent and announced the results an hour later.</p>
<p>That was the pattern that observers reported: Results were announced even when documents were missing, incomplete, unsigned by officers or party representatives, incorrectly tabulated, photocopied or forged.</p>
<p>&#8220;Both sides stole votes,&#8221; said Julius Melli , a 31-year-old Kenyan radiographer who witnessed the tallying of Maragua and other locales. &#8220;But Kibaki stole more, and they stole it inside the tallying center.&#8221;</p>
<p>The Electoral Commission of Kenya , an independent body whose members are appointed by the president, had run national elections in 2002 and 2005 that were praised for their openness and accuracy.</p>
<p>But except for Kivuitu, who&#8217;d served as chairman since 1997, this was a largely different commission. As members faced term limits in the months before the vote, Kibaki— facing the stiffest presidential challenge ever in Kenya — packed the 22-person body with 17 new commissioners. All were considered Kibaki allies, and none had ever run an election.</p>
<p>&#8220;These people were criminals,&#8221; said Ben Sihanya, a Stanford -educated constitutional law professor who also observed the tallying. &#8220;They were committing crimes at the behest of Kibaki&#8217;s government.&#8221;</p>
<p>Election officials were unreachable for comment, but the commission has taken out a two-page, unsigned advertisement in Kenyan newspapers to deny wrongdoing.</p>
<p>Koki Muli , the co-chair of the Kenya Domestic Observers Forum , suspected problems soon after the polls closed on the evening of Dec. 27 . <em>Her network of observers monitoring the vote-counting in polling stations immediately began sending preliminary results by phone and text messages. But for two days, in the Nairobi convention hall where the election commission had set up shop— surrounded by hundreds of journalists, observers and party agents— Kivuitu announced only some of the returns.</em></p>
<p>Observers grew suspicious when results from Kibaki&#8217;s central Kenya stronghold weren&#8217;t read. The delays were sparking protests. &#8220;It was necessary for us to observe the tallying,&#8221; Muli said.</p>
<p>For 48 hours, armed agents barred observers from entering the tallying center, a high-ceilinged room almost the size of a football field. Finally, faced with mounting reports of irregularities, Kivuitu allowed five observers and a handful of political party representatives into the room on the night of Dec. 29 . They were greeted with nervous stares.</p>
<p>&#8220;What I saw in that room alarmed me,&#8221; Muli said. &#8220;It was a very scared staff.&#8221;</p>
<p>Commissioners and staff members were seated around a dozen or so long tables, each strewn with folders containing the legal forms required to certify vote counts. In one corner of the room, a bank of computers churned out results and printouts.</p>
<p>The lanky, bespectacled Sihanya walked up to a table and introduced himself to commissioner Mildred Owour . &#8220;Can we sit at your table?&#8221; he asked.</p>
<p>&#8220;You are going to slow down the process,&#8221; she replied.</p>
<p>At about 10 p.m. , Sihanya, Melli and two other observers sat down with agents of the main political parties and several commissioners and election officials. Their task was to scrutinize irregularities reported by Odinga&#8217;s camp— and there were many.</p>
<p><em><strong>In at least 44 out of 210 constituencies, officials in Nairobi had announced vote totals without any supporting documents from the polling centers. In most places the announced totals were off by hundreds or thousands from what journalists, party agents and foreign observers had witnessed at polling places.</strong> </em></p>
<p>The team prepared to work through the night. When commission staff members brought a stack of folders, observers asked to check whether vote totals had been added correctly.</p>
<p>The commission&#8217;s legal officer, Jemimah Kelli , rebuffed them.</p>
<p>&#8220;She said, &#8216;We can&#8217;t correct the tallying now. The commission will take care of it,&#8217;&#8221; Sihanya recalled.</p>
<p><strong><em>At another table, Muli was scratching her head over results from Mathira, in central Kenya , where nearly everyone voted for Kibaki. Election officers had failed to sign the tallies from nearly three dozen polling places, and one form had two different totals. Muli took out her cell phone and began adding up the numbers. </em></strong></p>
<p><strong><em>She calculated 77,442 votes for Kibaki, some 2,600 fewer than what was recorded on the final tally sheet and announced to the public. Later she discovered inflated vote totals for Kibaki in several other areas— &#8220;3,000 here, 3,000 there, 1,500 here, 2,500 there,&#8221; she said. &#8220;It added up.&#8221; </em></strong></p>
<p><strong><em>At his table, Melli saw numerous constituencies that lacked tally sheets or official signatures, but whose results had been certified anyway. In one folder, he found two tallies for the same place— one a signed original, the other an unsigned photocopy that had been altered to give Kibaki about 3,000 more votes. </em></strong></p>
<p><strong><em>The photocopied version had been used.</em></strong></p>
<p>&#8220;It looked very ridiculous,&#8221; Melli said. But Kenyan election laws didn&#8217;t authorize observers to do anything more than note inconsistencies.</p>
<p>The legal officer, Kelli, moaned that officials had gone without sleep for several days, and she harassed Melli for paying too much attention to detail.</p>
<p>&#8220;She told Melli, &#8216;You seem to be very keen. Are you being paid to do this?&#8217;&#8221; Sihanya said. (They in fact were not paid.)</p>
<p>When Sihanya questioned inconsistencies in one Kibaki stronghold, a Kibaki party representative, <strong>Martha Karua,</strong> accused him of being an opposition agent.</p>
<p>&#8220;The whole thing seemed extremely stage-managed,&#8221; Melli said. &#8220;It was not a sincere verification exercise.&#8221;</p>
<p>As the night wore on, officials became cagier. <strong><em>Melli asked an official for the file from Nithi, where turnout was a suspiciously high 80 percent and nearly all the votes had gone to Kibaki. The official blanched, pulled the file close to his chest and, for the rest of the night, carried it with him everywhere he went, Melli said. </em></strong></p>
<p><strong><em>The file for Kieni in central Kenya showed 87,500 parliamentary votes— nearly 3,000 more than the number of registered voters. The file for Imenti South district, where Kibaki had 96 percent support, showed 4,315 more presidential votes than parliamentary votes but contained no supporting documents. At 5 a.m. on Dec. 30 , the file for another central district, Molo, finally appeared showing 50,145 votes for Kibaki. The chairman later announced 75,261. </em></strong></p>
<p><strong><em>&#8220;They just gave Kibaki 25,000 votes from the air,&#8221; Muli said. </em></strong></p>
<p>Finally, at around 9 a.m. , Karua, the Kibaki aide, said the verification had to be halted so that the commissioners could get &#8220;back to work.&#8221; An Odinga aide said he had concerns about other files, but Karua and three election officials at the table stood up to leave.</p>
<p>One of the commissioners, Luciano Riunga Raiji, told the observers, &#8220;You are done.&#8221; Shortly afterward, a message blared over the loudspeaker ordering all observers and party agents to leave the room. By then, Melli said, it was clear that the commissioners had no intention of investigating the irregularities.</p>
<p>&#8220;We were waiting for them to announce the final results,&#8221; he said. &#8220;But we knew Kibaki had stolen it.&#8221;</p>
<p>Muli, who&#8217;s helped train commissioners for 14 years, said: &#8220;We didn&#8217;t imagine that the electoral commissioners could in a massive way influence the conduct of the election. We were wrong.&#8221;</p>
<p>The next several hours were surreal, the observers said. As word swept through the convention hall that Kibaki would be declared the winner, Odinga called a news conference and accused the commission of rigging the vote in 48 constituencies.</p>
<p>A few hours later, the opposition trotted out an election staffer, Kipkemoi Kirui, who said that officials were manipulating results at the tallying center. &#8220;My conscience could not allow me to see what I was seeing and keep quiet,&#8221; Kirui told reporters. He&#8217;s now fled the country, according to media reports.</p>
<p>An hour after that, the lights went off in the convention hall, and paramilitary police cleared the building. In a sealed room, the election chairman announced Kibaki&#8217;s victory on state television. Within minutes, rioters were tearing through the streets of Nairobi .</p>
<p>Kenya&#8217;s nightmare had begun.</p>

This is a message for all Kenyan democrats and peace loving people all over the world.<br />
  <br />
  If nobody would, let me declare today that Hon. Raila Amolo Odinga is the President of the Republic of Kenya.<br />
 <br />
  Election is for the purpose of picking the winner. Kenyans and the world know that Hon. Raila Amolo Odinga was elected on December 27, 2007 as the president of Kenya. We do not need another election.<br />
  <br />
  Next in line to officially swear-in and instal Hon. Raila Amolo Odinga as the president of the Republic of Kenya.</p>
<p>  In the meantime while these little difficulties persist let us see Hon. Raila Odinga as Kenya&#8217;s full time president, duly elected and legitimately in office.<br />

KENYANS,</p>
<p>When I read what most of our fellow Kenyans are now writing, I am very convinced that most of them do not actually know the real TRUTH about our present PROBLEMS. Some think that the problem is RAILA. I do think that the problem  is NOT.</p>
<p>Look at even Kibera slums, when was this slum built or started to spring? In fact, Kibera started when Raila was still a student in Germany, so Raila did NOT start that slum.</p>
<p>Secondly, the unjust development in Kenya, where a group of president`s tribes mates dominate the country started during JOMO KENYATTA. Raila did not do that.</p>
<p>Some say that ODM should just keep on going as opposition, because in some years back, Matiba won but Moi did not give up, or Kibaki won some elections during Moi`s time but no violence, that people just kept on going on with life. Can you really hear what you are saying you people?</p>
<p>You are saying that in KENYA You give credit to LOSERS and promote losers to carry on losing, while winners are constantly being PUNISHED. We do not give winners what they get instead we give away their gifts to losers.  What is wrong with us?</p>
<p>Did some of you read what Dr. JAMES WATSON said about black people compared to white people in terms of IQ? Do you want to say that Dr. Watson was right to say that blacks&#8217; IQs are lower than whites&#8217; and, therefore, blacks are more stupid than whites?</p>
<p>In fact our action will always determine what we are, we do not need to shout that people are the same while we keep on doing the opposite of the right thing. Now Kibaki did not win the election and the whole world has said that.   Why can`t this sink into some Kenyans&#8217; brains?  How come only a few Kenyans are right while even Kivuitu the chairman of ECK said that he was forced to annouce that Kibaki won?</p>
<p>Raila should get what he won, that is the presidency, and we do not want this thing to be another problem in 2012. How many Kenyans want their lovely homes to be burnt again in 2012? Or how many want Kenya to have another mass killings in 2012? I hope none unless you are sick.</p>

   The calls for mass action by ODM epitomizes the glaring lack of a post election victory strategy.<br />

  Put simply, this strategy was hinged on Kibaki&#8217;s presumed benevolence and the precedent that had been set in 2002 when Moi handed over power peacefully. And what a saint Moi now looks like thanks to Kibaki. All 24 years of inaptitude have been wiped out of the majority of Kenyans and the international community memory.<br />
  <br />
  From 2005 when ODM scored a moral boosting victory in the referendum against Kibaki and his henchmen, ODM should have known that Kibaki had no intention of giving up power let alone share it with anyone outside his nucleus of Mt. Kenya golfing buddies. Infact this had rightly been captured by Mutahi Ngunyi in his now famous article from 2003.<br />
  <br />
  Right before the referendum and after, Kibaki had exhibited a great disregard for the other arms of governance namely the legislature and the Judiciary as he entrenched his dictatorship on Kenyans. Clear examples of this are his distribution of title deeds to squatters in the Rift Valley despite a court order outlawing that very act. Another one was his wanton poaching of opposition MPs through bribes to prop up his government. Interestingly, Kibaki&#8217;s sycophants, or are they the real power behind the throne, are busy telling the opposition to respect these same institutions.<br />
  <br />
  So come the 2007 elections, ODM should have known that relinquishing power was not an option for Kibaki and for them not to have had a plan B in this eventuality is a gross disservice not only to the millions who voted for the party but to the about 1000 lives that have been lost so far.<br />
  <br />
  Sample this excerpt from an article titled aptly Kenya crisis: A case of a bank robber agreeing to share the loot by Omar Kalinge Nnyago in the Ugandan Daily Monitor:</p>
<p>  Kibaki knows all too well he can get away with the election theft, for as long as he promises to support the war on terror and not disturb the profit margins of the multinationals. Raila knows too that the so-called donors do not believe in the democracy they preach, or even export by even force of arms as in Iraq and Afghanistan. What a loaded statement.<br />

			<content:encoded><![CDATA[<div class='snap_preview'><br /><p>The latest Kenyan election was a tragedy that has stirred waves that will take decades to calm down. This tragedy was caused by the desire by a group of people to own and exercise power upon others and depending on the side one belongs, the culprit is obvious. Election was the means to acquire power, voting was the vehicle to deliver power, and the Electoral Commission of Kenya (ECK) was the custodian of the vehicle. Somewhere along the journey, the ECK abdicated its responsibilities to the perceived owners of power and the rest is now a painful history. What is the genesis of this perception and who are the perceived owners of power in Kenya?</p>
<p>A brief historical tour to 1969 assassination of Mr. Thomas Mboya would shed some light on this perception. Mr. Mboya was a natural born leader in Kenya but was not of the right ethnic origin as stated by both Hillary Ng’weno in his recent “Making of Nation” documentary serialized in the Daily Nation newspaper and also by Duncan Ndegwa in his autobiography, “Walking in Kenyatta’s struggles”. A group from the Gikuyu felt threatened by Mr. Mboya’s charisma and abilities, they planned for his elimination and convinced an entire community to take oath after his death. This oath taking was vehemently opposed by a few upright clergy from the community. This action was the first sign that a group within the community believed that power in Kenya belonged to them at whatever cost. In Nyanza, the home province of Mboya, the rejoinder to his death was swift and catastrophic to any member of the Gikuyu residing in Nyanza.</p>
<p>At about 1976/77, this same group realizing that President Kenyatta’s days were coming to an end, started campaigning for change in the Kenyan constitution so that the then Vice President, Mr. Daniel Moi, did not have to act as president in case the president died in office. The reason for this was to prevent power from shifting to a different group, even if it was just for as short a time as 90 days that the constitution allowed the acting president before an election. This idea was forestalled by Mr. Charles Njonjo and power was for the first time outside of the Gikuyu group. However, this did not go well with the group and the struggle to ascend to power again was on. Mr. Moi’s dictatorial tendencies and incompetence brought other groups together to remove Moi from power. With other communities not knowing that the Gikuyu power owners were waiting on the sides to pounce on to power and never ever let go, they voted for Kibaki as a Kenyan but not a Gikuyu.</p>
<p>In 2002, power was inadvertently handed over to the Gikuyu by most Kenyans who detested Moi’s protégé, Uhuru Kenyatta, another Gikuyu. Most people had either forgotten the previous mechanization of a few Gikuyu to consolidate power within their community or thought such ideas were archaic and did not apply to Kenya in the 21st century. They were all wrong! for plans to keep power within the community was mooted by the then Minister of Transport and Communication Mr. John Michuki who is reported to have said that reduction of presidential powers were not necessary now that one of their own was in power. Kibaki government derailed the devolution of presidential powers and emasculated the opposition by forming a government of national unity. This forgetfulness or naivety of Kenyans in December 2002 has caused deaths and tension between most groups on one side and the Gikuyu on the other, never seen in Kenya before elections on December 27th, 2007. The euphoria with which Kenyans ushered in Kibaki in 2002 was buried in 2007. Kibaki was recently sworn in without jubilation and fanfare.</p>
<p>The Gikuyu groups who feel ordained by fate to rule Kenya were so intoxicated by power such that they rigged elections while in a daze. The rigging lacked any iota of intelligence, a manifestation of crude arrogance cushioned by perceived invisibility that power breeds. The blood of fellow Kenyans, and especially the Gikuyu living in areas where the Gikuyu are not predominant, suffered the same fate as in 1969. Unfortunately, this time it was not limited to Nyanza but countrywide. At this point I could quote from an article by Dr. Keith Jennings in Fahamu that, “the peace in Kenya was breached long before the day when elections were stolen. Sanctimonious call for peace, compromise and reconciliation will do no good when the people’s confidence in the democratic process is what is at stake and the legitimacy of those making calls for law and order or respect for the rule of law is questioned.”</p>
<p>It is sad to see the sacrosanct art of elections defiled by the same people who swore to protect its inviolability. The Gikuyu group believes nothing happened and those who saw something are power hungry- very ironic indeed! For those of us who believe that democratic ideals need to be guarded jealously and that freedom of any kind is never given on a silver platter, I leave you to ponder on the words of Frederick Douglass, “If there is no struggle, there is no progress. Those who profess to favour freedom, and yet depreciate agitation, are men who want crops without plowing up the ground. They want rain without thunder and lightning. They want the ocean without the awful roar of its many waters. Power concedes nothing without demand. It never did and it never will.”</p>

<p>&#8220;It is only the Kikuyus who can now mock their mad Emperor going around without any clothes and laugh him out of State House for this blatant disrespect for the people of Kenya. If they are under any delusions of reviving the Kenyatta formula of a ruling Gema clique with a few Bukusu, Digo, Kisii frontmen they are highly mistaken. Tuju, Mungatana and Mwakwere would be tyred instantly if they dare to set foot in their own constituencies today! Yet we still have the Kibaki apologists blogging away (going even so far as saying that ODM were rigging, when the entire ECK, election staff, state organs, etc were controlled by the incumbent!), they should instead be pointing fingers at their own naked Emperor!&#8221;<br />

<p>Like many of you,I don&#8217;t have time to watch many entertainment programs. That said,once in a while I join the family in watching some programs.</p>
<p>The one that I like most is when they give out the awards to those who have worked hard and are now being appreciated. After a certain category has been highlighted,there is always a moment of great anticipation when the presenters say,&#8221;And the winner<br />
is&#8230;..? This is followed by some kind of shouting and clapping to acknowledge the winner.</p>
<p>The last several weeks my mind has found itself in the wilderness trying to figure out how the situation at the motherland is going to end.</p>
<p>Unless there is an acceptable and workable agreement that will satisfy all Kenyans, I am afraid that when all is said and done, there will be no winner. If anything, Kenya as a nation will be the loser.</p>
<p>Think with me if you can of the following:</p>
<p>1. Students will be forced to transfer to schools near their home so as to avoid any kind of revenge.</p>
<p>2. Teachers who have heretofore worked anywhere in Kenya will have to think twice.</p>
<p>3. Most schools might end up being closed for lack of students and teachers.</p>
<p>4. People who have heretofore worked,owned property,and lived anywhere in Kenya will have to think twice.<br />
5. Most industries that have benefited from outsiders will greatly be affected. In the process many Kenyans will lose jobs.<br />
6. Whoever will be the president will have it hard to rule the country who deep in their hearts are un-willing. Who will want to be a president in a country that you will not freely move and govern. You don&#8217;t want your subjects to heckle at you or even call you names.</p>
<p>7. Economic sanctions will affect many ordinary Kenyans.</p>
<p>Brothers and sisters, there is need to avoid the blame game and get down to finding a lasting solution.</p>
<p>Remember this is neither a Kikuyu-Luo issue nor is it a Kibaki-Raila issue, but one that touches every single Kenyan.</p>
<p>Let us all join hands as we find a lasting solution. Shall we?</p>
<p>Just a thought.</p>
<p>My prayers and thoughts are with all Kenyans wherever they are scattered.</p>

I know this topic has been beaten to death recently, but something still needs to be said. Kibaki and his Kikuyu henchmen stole the elections! Think of all the lives that could be saved if he would just bear witness to the plain, unvarnished truth the he stole democracy. I am hurt, furious, and embarrassed. Why am I hurt? Because if Kibaki’s henchmen had done its homework, it&#8217;d know that its judgmental, tasteless foot soldiers exert themselves to muddy the water, obfuscate the record, and cover up, by lies and denials, all of Kibaki&#8217;s Government&#8217;s egocentric contretemps.</p>
<p>I don&#8217;t know if it&#8217;s stupidity, ignorance, or naïveté that makes Kibaki and his henchmen contend that clever one-liners are a valid substitute for actual thinking, but they have taken Kenyans for a ride. Kibaki’s vaporings should be recognized, but only as a complete fraud. Kibaki&#8217;s Government enables contemptible loonies such as Lucy Kibaki, Michuki and Martha Karua to punch above their weight. The result will be an amalgam of chaos, displacement and economic meltdown for our country. Ask Kibaki one month on about any of his advocates who bring this battle to a fever pitch, and the delirious mattoid will probably say, &#8220;I never meant they should go that far.&#8221; Yeah, right. It will be too late to repair the damage. And if it wasn’t for these deranged abusive radicals, his government might have had a chance through dialogue  with Raila.  Due to a lack of coherent and sincere dialogue, Kibaki&#8217;s Government always ends up causing riots in the streets. African dictators of yesteryears usually have sanctimonious tendencies that make them want to<br />
cling on to power and herald the death of a feeble democracy!</p>
<p>Kibaki and his henchmen are responsible for spilling the blood of the peacefully protesting Kenyans. This is a terrible and grave responsibility &#8211; a crushing responsibility. We will hold them accountable.  Raila shouldn’t shy away from dialogue and justice.</p>
<p> ODM should not waver; should not tire; and, we will not fail</p>

<p>Kenyans are already dead, mungiki killed them long, long ago. Kibaki is a thief, greedy man and a mpumbavu he never realises. Raila stands the best material in kenya for the people. Raila must assure kenyans that legal inquiries shall be put into place and all criminals including Kibaki, who is a thief, shall answer in a court of law and no stone shall be heavy with ODM in power. The police must stop fooling themselves that they shall be excused.  They must be charged and this is very soon.  And the charges shall be very heavy.  That will show young kenyans who join the police not to turn the gun to the public for the public is the boss-OPADO<br />

<p>Washington, DC – The International Republican Institute (IRI) today issued the following statement in regards to an exit poll it conducted conjunction with Kenya&#8217;s December 27 elections.</p>
<p>&#8220;McClatchy Newspaper recently ran an article &#8220;Kenyan president lost election, U.S. exit poll indicates,&#8221; which questioned why IRI has not released an exit poll it conducted in conjunction with the December 27 elections.</p>
<p>&#8220;The article claims that the poll &#8216;further undermines an election result that many international observers have described as flawed.&#8217;</p>
<p>&#8220;The decision to not release the poll was made because there were concerns about the validity of the initial results, which were based on incomplete raw data in part because the violence throughout Kenya has delayed the return of questionnaires.</p>
<p>&#8220;IRI&#8217;s polling work in Kenya is a capacity building program for the development of public opinion research, and it is our responsibility to thoroughly examine the data collected and work with our local partner to ensure the most accurate results.</p>
<p>&#8220;IRI will not release any polling results unless and until we are confident in the integrity of the data. For IRI to rush to release a poll that was incomplete and very likely inaccurate would have been irresponsible and dangerous given the situation in Kenya.&#8221;<br />
